Acceptance of Terms
By accessing or using StrataFit, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
Eligibility
You must be at least 13 years old to use StrataFit. By creating an account you confirm that you meet this minimum age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these terms on your behalf.
Use of Service
StrataFit provides AI-powered fitness coaching and tracking tools. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
Health Disclaimer
StrataFit is not a medical device and does not provide medical advice. The service — including AI coaching, workout plans, nutrition guidance, and any other content — is provided for informational and general wellness purposes only. Nothing in StrataFit constitutes, or should be treated as, a diagnosis, treatment recommendation, or substitute for professional medical, nutritional, or psychological advice.
AI coaching is informational only. Responses generated by the AI coach are based on the information you provide and general fitness principles. They are not tailored to your full medical history and may not be appropriate for your individual circumstances. AI-generated responses should not be relied upon as professional health or fitness advice.
Consult a qualified professional before starting any programme. Before beginning any new exercise programme, making significant changes to your diet, or acting on any health-related content from StrataFit, you should seek advice from a qualified healthcare provider, accredited exercise physiologist, or registered dietitian — particularly if you have a pre-existing medical condition, are pregnant, or have not exercised regularly in the past.
Stop activity and seek help if you feel unwell. If at any time during exercise you experience chest pain, shortness of breath, dizziness, unusual pain, or any other concerning symptom, stop immediately and seek medical attention. Do not rely on StrataFit to assess or respond to medical emergencies.
Subscriptions & Payments
Paid subscriptions are billed monthly or annually in Australian Dollars (AUD) including GST where applicable. You may cancel at any time; cancellation takes effect at the end of the current billing period.
Subscriptions renew automatically. Unless you cancel before the end of the current period, your plan renews for another period of the same length and the same payment method is charged at the then-current price. A monthly plan renews every month; an annual plan renews every 12 months. You can cancel at any time from Settings → Subscription, or through the Stripe billing portal linked there, and you keep access until the end of the period you have already paid for. Cancelling stops the next renewal; it does not by itself refund the current period. We will give you reasonable notice before any change to your renewal price.
14-day free trial. The 14-day free trial is a one-time offer available to first-time subscribers. If you have previously held a subscription with us — including one you cancelled — your new plan begins billing immediately, with no trial period. Where a trial applies, you will not be charged until it ends, and you may cancel before it ends without being billed. Contact support@stratafit.app if you have any billing questions.
Nothing in these terms limits any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2), including consumer guarantees that cannot be excluded by contract.
Limitation of Liability
To the maximum extent permitted by law, StrataFit's liability for any claim arising out of or in connection with these terms is limited to the amount you paid us in the 12 months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the service. Where applicable law (including the Australian Consumer Law) does not permit such a limitation, our liability is limited to the fullest extent permitted.
Intellectual Property
All intellectual property rights in the StrataFit platform — including software, design, branding, and AI models — are owned by or licensed to StrataFit. Nothing in these terms grants you any right to use StrataFit's intellectual property other than as necessary to use the service in accordance with these terms.
User-Generated Content
You retain ownership of all content you upload or create within StrataFit (“User Content”), including workout logs, progress photos, notes, and any other material you contribute.
Licence to StrataFit. By uploading or posting User Content, you grant StrataFit a non-exclusive, royalty-free, worldwide, sublicensable licence to store, reproduce, process, and display that content solely as necessary to provide and operate the service for you. This licence does not extend to use of your User Content in advertising, marketing materials, or public-facing communications without your explicit written consent.
Prohibited content. You must not upload or post User Content that:
- infringes any third-party intellectual property, privacy, or other rights;
- is unlawful, defamatory, harassing, threatening, or fraudulent;
- contains malware, viruses, or other harmful code;
- depicts or promotes dangerous or illegal activities, including activities that could endanger health or safety; or
- violates any applicable law, including Australia's Online Safety Act 2021.
Moderation. StrataFit reserves the right to review, moderate, restrict access to, or permanently remove User Content that violates these terms or that we reasonably consider harmful or inappropriate, without prior notice to you. We are not obligated to monitor all User Content but may do so.
You warrant that your User Content does not infringe any third-party rights and complies with all applicable laws.
Termination
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
Dispute Resolution
We prefer to resolve disputes fairly and promptly without the expense and delay of formal proceedings. If you have a concern or complaint about StrataFit, please follow these steps before initiating any legal action:
- Good-faith negotiation. Contact us at support@stratafit.app describing your concern in reasonable detail. We will acknowledge your message within 5 business days and endeavour to reach a mutually agreeable resolution within 30 days.
- Mediation. If we cannot resolve the dispute through direct negotiation, either party may refer the matter to mediation administered by a mutually agreed mediator or a recognised mediation body in Victoria, Australia. The costs of mediation will be shared equally unless otherwise agreed. Participation in mediation is a condition precedent to commencing litigation, except where urgent interlocutory or injunctive relief is required.
- Litigation. If mediation does not resolve the dispute within 60 days of referral (or such longer period as the parties agree), either party may pursue the matter through the courts as set out in the Governing Law section below.
Nothing in this clause limits your rights to lodge a complaint with the Australian Competition and Consumer Commission (ACCC), the Office of the Australian Information Commissioner (OAIC), or any other applicable regulatory body.
Governing Law
These terms are governed by the laws of the State of Victoria, Australia. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia, and the Commonwealth courts having jurisdiction there. Nothing in this clause affects your rights under the Australian Consumer Law.
